These Terms & Conditions govern your access to and use of:

the Soul × Systems × Scale™ (“SSS”) website and online resources;

our online platform;

free workshops and events;

paid reports, including the Soul to Scale Business Map;

the Soul × Systems × Scale™ business accelerator;

coaching, education, implementation and support services; and

any related digital products or services supplied by Alesmarc Pty Ltd and Empowered Business Harmony (Kirstin Wilson) (“SSS”, “we”, “us” or “our”).

By registering for, accessing or purchasing a service, you agree to these Terms.

If you do not agree with these Terms, do not purchase or use our services.

These Terms should be read together with our Privacy Policy, available at sss-tool.wisdome.com.au/privacy.

SSS is operated by:

SSS provides business coaching, education, implementation support, digital resources and related services for established and emerging women entrepreneurs and knowledge experts.

Our services may include:

3.1 Free workshops and events

Free workshops, masterclasses and events may be provided online or in person. We may change the date, time, facilitator, delivery method or content where reasonably necessary.

Where we cancel an event, we will make reasonable efforts to provide an alternative date, recording or other appropriate option.

Free workshops are educational only and do not create a coaching, consulting, fiduciary, employment, partnership or professional-client relationship.

3.2 Soul × Systems × Scale™ accelerator

The Soul × Systems × Scale™ program is a structured business accelerator generally comprising:

a 12-week live group accelerator;

implementation support;

strategic coaching and education;

Human Design and related personal-development work;

access to selected digital resources;

access to our online platform; and

additional support for approximately nine months following the core accelerator.

The exact inclusions, dates, delivery format, support arrangements, price and duration will be set out on the relevant sales page, proposal, order form or enrolment confirmation.

The program is designed to support business clarity, offer development, client journeys, implementation and scalable systems. We do not guarantee any particular business, financial, personal or revenue outcome.

3.3 Paid digital reports

Paid reports may include the Soul to Scale Business Map, currently offered at approximately A$90–99, and other reports or digital guides offered from time to time.

A paid report may be generated using information supplied by you, including your:

full name;

email address;

birth date;

birth time;

birth timezone;

birth city or place; and

other information requested on the relevant form.

The report may include a computed Human Design summary, including type, authority, profile, centres and gate activations, together with “genius domain” or similar interpretive text outputs.

Reports are intended to provide a personalised business and personal-development perspective. They are not medical, psychological, psychiatric, therapeutic, legal, tax, accounting, financial or investment advice.

3.4 our online platform

our online platform may provide CRM, learning-management, communication, digital-content, course-delivery or community functionality.

Your access to our platform may be subject to additional platform terms, acceptable-use requirements, technical limitations and third-party provider terms. You must keep your login details confidential and must notify us promptly if you suspect unauthorised access.

We may suspend or restrict access where reasonably necessary for security, maintenance, non-payment, misuse or legal compliance.

Our services are intended for adults.

By using our services, you confirm that:

you are at least 18 years old;

you have legal capacity to enter into a contract;

the information you provide is accurate and current; and

you are purchasing or using the services for lawful purposes.

If you are purchasing on behalf of a business, you confirm that you have authority to bind that business.

You may need to create an account or provide registration details to access some services.

You agree to:

provide accurate, complete and current information;

update your information when it changes;

keep passwords and access credentials secure;

not share your account or paid content with another person;

notify us promptly of suspected unauthorised access; and

comply with reasonable platform and community rules.

You are responsible for activity conducted through your account unless that activity resulted from our failure to maintain reasonable security.

Where a service requires birth details, you are responsible for providing accurate information, including:

birth date;

birth time;

birth timezone; and

birth city or place.

The accuracy of the report may depend on the accuracy and completeness of the information supplied.

We are not responsible for inaccuracies caused by information that is incorrect, incomplete, estimated or entered into the form incorrectly.

If you later identify an error, contact us at sss@wisdome.com.au. We may correct the information or regenerate the report where reasonably possible.

Prices are stated in Australian dollars unless otherwise indicated.

The applicable price is the price displayed at the time of purchase, except where an obvious pricing error has occurred.

Payment may be processed through Stripe or another payment provider displayed at checkout. By submitting payment details, you authorise the relevant payment provider to process the transaction.

We do not receive or store your full payment-card number. Payment information is handled by the relevant payment provider under its own terms and privacy policy.

For payment plans:

each instalment must be paid by its due date;

you authorise recurring charges where applicable;

failure to pay may result in suspended access;

we may recover reasonable costs associated with failed payments; and

cancellation of a payment method does not automatically cancel the underlying payment obligation.

We may use third-party payment providers, including Stripe, and cannot guarantee uninterrupted availability of their systems.

8.1 Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

Our services come with consumer guarantees that cannot be excluded where those guarantees apply. Depending on the circumstances, a consumer may be entitled to a repair, re-supply, replacement, refund, cancellation or compensation.

8.2 Paid digital reports

Unless required by law, a change-of-mind refund may not be available after:

the report has been generated;

the report has been delivered or made available; or

we have commenced substantial work on a personalised report.

If the report is not supplied, is materially different from its description, or contains a significant technical error that we cannot reasonably correct, contact us at sss@wisdome.com.au. We will assess the issue and provide any remedy required by law.

8.3 Programs and coaching services

Cancellation and refund arrangements for the accelerator or other coaching services will be set out in the relevant enrolment agreement, order form or sales page.

Unless a different written arrangement applies:

fees for services already provided are not refundable merely because you choose not to participate;

you remain responsible for any payment-plan instalments that have become due;

failure to attend a session does not automatically entitle you to a refund; and

we may offer a recording, rescheduled session or alternative resource where appropriate.

This section does not limit any statutory consumer guarantee or other legal right.

8.4 Requesting a refund

Refund requests should be sent to sss@wisdome.com.au and include:

your full name;

purchase email address;

order or transaction reference;

the service purchased; and

the reason for your request.

Where a refund is approved, it will generally be returned to the original payment method.

Our services are educational and interpretive.

Human Design, Gene Keys, personality frameworks and related tools are used as reflective or exploratory frameworks. Reports and coaching may help you consider your preferences, patterns, decisions, business structure and working style.

They are not intended to:

diagnose, treat or prevent a medical or mental-health condition;

replace medical, psychological or therapeutic care;

provide legal, tax, accounting, financial or investment advice;

determine whether a person is suitable for employment, insurance, credit or any other regulated purpose;

guarantee business success, income, sales, client results or personal transformation; or

direct you to make a particular personal, professional, health or financial decision.

You remain responsible for evaluating the information and deciding whether and how to use it.

Nothing in our services creates a doctor-patient, psychologist-client, lawyer-client, accountant-client, financial-adviser-client, fiduciary, employment, partnership or agency relationship.

We do not guarantee that you will:

earn a particular amount of money;

attract a particular number or type of clients;

launch or grow a business;

achieve a particular business result;

experience a particular personal result;

obtain funding, approval or professional accreditation; or

achieve a particular level of productivity, confidence or wellbeing.

Results depend on factors outside our control, including your circumstances, actions, resources, market conditions, experience, offer, pricing, implementation and business decisions.

Testimonials and examples are illustrative only and are not guarantees of your results.

You agree to:

participate respectfully and constructively;

complete any preparation or implementation activities you choose to undertake;

make your own business and personal decisions;

obtain independent professional advice where appropriate;

protect confidential information shared by other participants;

not record, copy, distribute or publish group sessions without permission;

not harass, threaten, discriminate against or exploit another participant;

not upload unlawful, harmful, offensive or infringing material;

not use our services to develop a competing product or service;

not attempt to gain unauthorised access to our systems; and

comply with all applicable laws.

We may suspend or terminate access for serious or repeated misconduct, unlawful activity, non-payment, misuse of content or conduct that materially affects the safety or experience of others.

All materials supplied by SSS or made available through our services are owned by or licensed to SSS or its licensors.

This includes:

course materials;

workbooks;

templates;

frameworks;

videos;

audio;

written content;

report formats;

report text;

graphics;

software;

platform content;

trade marks;

business methods; and

the Soul × Systems × Scale™ brand assets.

Subject to payment of all applicable fees, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use purchased materials for your own personal or internal business-development purposes.

You must not, without our written permission:

resell or sublicense materials;

reproduce or republish materials;

upload materials to a public website or shared library;

distribute materials to another person;

use materials to provide services to clients or customers;

remove copyright or branding notices;

claim our materials as your own;

create a competing product using our materials; or

commercially exploit any report, framework, course or resource.

You retain ownership of original information, business content and materials that you provide to us. You grant us a licence to use that material only as reasonably necessary to provide, administer and improve the services, subject to our Privacy Policy.

We will take reasonable steps to keep confidential information you provide to us confidential, subject to:

information that is already public;

information independently developed or lawfully received from another source;

disclosures required by law;

disclosures to professional advisers, contractors and service providers who need the information to support our business; and

information shared by you in a group setting where other participants may see or hear it.

You must respect the confidentiality of other participants and must not use, publish or disclose their personal information, business information, recordings, comments or materials without permission.

Our services may rely on third-party providers, including:

Stripe for payments;

Cloudflare D1 for private database storage;

MailerLite or another email provider;

Zoom or another video-conferencing provider;

our online platform or other learning and CRM systems; and

hosting, analytics, security and communications providers.

Third-party services may have their own terms, privacy policies, outages, restrictions and data-processing arrangements.

We are not responsible for a third party’s acts or omissions except to the extent required by law.

We collect, use, store and disclose personal information as described in our Privacy Policy.

Our Privacy Policy explains:

what information we collect;

why we collect it;

how we use and disclose it;

overseas processing and storage;

retention;

access, correction and deletion requests;

marketing communications;

security measures; and

how to make a privacy complaint.

For paid reports, the information supplied may include birth details and report outputs that may reveal or infer information about a person’s philosophical, spiritual or personal beliefs.

Where required, we will obtain separate express consent before collecting, using or storing that information. Acceptance of these Terms is not intended to replace any separate consent notice presented at the point of data collection.

You may withdraw consent by contacting sss@wisdome.com.au. Withdrawal may affect our ability to generate, reproduce or support a report, but does not affect processing that we are required or permitted to undertake by law.

By registering for a workshop, purchasing a service or contacting us, you may receive service-related communications, including confirmations, reminders, account messages and support communications.

We will only send promotional communications where permitted by law and, where required, with your consent.

You may unsubscribe from marketing communications at any time using the unsubscribe link or by contacting sss@wisdome.com.au. Unsubscribing from marketing does not stop essential service or transaction communications.

We aim to provide reliable services but do not guarantee that websites, platforms, downloads, recordings or communications will always be available, uninterrupted, secure or error-free.

We may update, replace or improve materials, delivery methods, facilitators, platforms or session times where reasonably necessary.

For a paid program, we will not make a material adverse change to the core service without providing reasonable notice and, where appropriate, a reasonable alternative or remedy.

To the maximum extent permitted by law:

we exclude liability for indirect, incidental, special or consequential loss;

we exclude loss of profits, revenue, business opportunity, goodwill, anticipated savings or data; and

we are not responsible for losses caused by your decisions, implementation, misuse of materials, inaccurate information or reliance on third-party services.

Nothing in these Terms excludes liability for:

fraud or fraudulent misrepresentation;

death or personal injury caused by negligence;

wilful misconduct;

a breach that cannot legally be excluded; or

a consumer guarantee or other right that cannot legally be excluded.

Where the law permits us to limit liability for a failure to comply with a consumer guarantee, our liability is limited to supplying the services again or paying the cost of having the services supplied again.

For business customers, and to the extent permitted by law, our total liability arising from a service will be limited to the amount paid or payable by that customer for the relevant service during the 12 months before the event giving rise to the claim.

This section does not apply to the extent that applying it would be unfair, unlawful or inconsistent with the Australian Consumer Law.

You indemnify SSS and its officers, employees and contractors against losses, claims, liabilities and reasonable costs arising from:

your breach of these Terms;

your unlawful or unauthorised use of the services;

your infringement of another person’s rights; or

information or materials you provide that are unlawful, misleading or infringing.

This indemnity does not apply to the extent that the loss was caused by our negligence, unlawful conduct or breach of these Terms.

You may stop using a service at any time.

We may suspend or terminate access where:

fees are overdue;

you materially breach these Terms;

you misuse or distribute our intellectual property;

your conduct creates a safety, security or legal risk;

the service is discontinued; or

suspension is reasonably necessary to protect our systems or other customers.

Termination does not affect rights or obligations that accrued before termination. Clauses concerning payment, intellectual property, confidentiality, privacy, liability and dispute resolution continue after termination.

If you have a concern, contact us first at sss@wisdome.com.au and provide details of the issue and the outcome you are seeking.

We will act reasonably to investigate and respond.

If the matter is not resolved, the parties should attempt to resolve it through a good-faith discussion or mediation before commencing court proceedings, except where urgent injunctive relief or another exception is reasonably necessary.

Nothing in this section prevents a consumer from contacting a relevant consumer-protection agency, tribunal or court, or exercising rights available under the Australian Consumer Law.

These Terms are governed by the laws of Victoria, Australia.

The parties submit to the courts and tribunals of Victoria and any appellate courts with jurisdiction.

This does not prevent a consumer from exercising rights in another forum where that right cannot lawfully be excluded.

We may update these Terms from time to time.

The updated Terms will be published at sss-tool.wisdome.com.au/terms with a revised effective date. A material change affecting an existing paid service will be communicated by reasonable means.

The Terms applying to a purchase are the Terms displayed or linked at the time of purchase, subject to any later variation permitted by law or agreed with you.

If any provision of these Terms is invalid, unlawful or unenforceable, it will be read down to the extent necessary or severed if it cannot be read down.

The remaining provisions continue in effect.

These Terms, together with any applicable order form, program-specific terms, payment plan, Privacy Policy and other written terms expressly incorporated into the purchase, form the agreement between you and SSS concerning the relevant service.

If there is an inconsistency, the following order applies:

mandatory rights under applicable law;

a signed or expressly accepted service agreement;

specific order or payment-plan terms;

these Terms; and

general website or promotional content.

This Privacy Policy explains how we collect, use, disclose, store and protect personal information when you:

visit our website;

register for a free workshop;

purchase a report or program;

use our platform;

participate in coaching or education;

contact us; or

otherwise interact with us.

We aim to collect only information that is reasonably necessary for our business and to handle it transparently and securely.

Depending on how you interact with us, we may collect:

2.1 Identity and contact information

full name;

email address;

telephone number;

postal or business address;

social media or account identifiers; and

organisation or business information.

2.2 Workshop and program information

registration details;

attendance records;

enrolment information;

communications with us;

goals, preferences and business information you choose to share;

coaching notes;

questions and feedback; and

recordings, images or comments where notice and permission apply.

2.3 Paid report information

For the Soul to Scale Business Map and similar reports, we may collect:

birth date;

birth time;

birth timezone;

birth city or place;

computed Human Design information;

type, authority and profile;

centres and gate activations;

genius domain or similar text outputs;

report preferences;

purchase details; and

information required to reproduce or support the report.

Some report information may reveal or infer personal, philosophical, spiritual or personality-related information. We treat this information with additional care and, where required, obtain express consent.

2.4 Payment and transaction information

We may collect:

payment status;

purchase amount;

currency;

product name;

invoice details;

payment processor session or transaction ID;

payment date and time; and

limited payment information supplied by the payment provider.

Payment-card details are processed by Stripe or another payment provider and are not stored by us.

2.5 Technical information

We may collect:

IP address;

browser and device information;

operating system;

referring pages;

approximate location;

access times;

website activity;

cookies and similar technologies; and

security and diagnostic logs.

We collect information:

directly from you;

when you complete a form;

when you purchase a service;

when you register for or attend a workshop;

when you use our platform;

from communications with you;

through cookies and website technologies;

from payment, email, hosting and platform providers; and

from publicly available sources where reasonably necessary.

Where practical, we will explain whether information is required or optional. If you do not provide information that is reasonably necessary, we may be unable to provide the relevant service.

We may use personal information to:

provide, personalise and support our services;

create and deliver free and paid reports;

reproduce or re-send a purchased report;

administer programs, workshops and events;

process payments and issue invoices;

manage accounts and platform access;

communicate about purchases, programs and support;

respond to enquiries;

maintain business and financial records;

improve our products, services and systems;

protect against fraud, misuse and security threats;

comply with legal obligations;

resolve complaints and disputes; and

send marketing communications where permitted and, where required, with consent.

We will not use paid-report birth details for unrelated marketing unless we have a lawful basis and appropriate consent.

Before you submit birth details for a paid report, we will provide a collection notice and, where required, seek express consent.

Suggested consent wording:

I expressly consent to Soul × Systems × Scale™ collecting, using and storing my birth details and the resulting Human Design and business report to generate, provide, reproduce and support my purchased report, including through overseas service providers described in the Privacy Policy.

Marketing consent should be separate and optional.

You may withdraw consent by contacting sss@wisdome.com.au. Withdrawal may mean that we cannot regenerate or support a report that depends on the information, but it will not affect processing that we are required or permitted to undertake by law.

We may disclose personal information to:

our team members, contractors and professional advisers;

payment providers, including Stripe;

database, hosting and security providers, including Cloudflare;

email and marketing providers, including MailerLite;

learning, CRM and community platforms, including our online platform;

video-conferencing and event providers;

website, analytics and technology providers;

accountants, lawyers, insurers and auditors;

regulators, courts, law-enforcement agencies or government authorities where required; and

a purchaser or successor in connection with a business sale, restructure or merger.

We do not sell your personal information.

We do not provide report content or birth details to advertisers for unrelated advertising purposes.

Some providers we use are located outside Australia or operate global infrastructure.

For paid reports:

report data may be stored in Cloudflare D1 within our Cloudflare account;

Cloudflare is headquartered in the United States and operates global data centres;

personal information may therefore be stored or processed in the United States and other countries;

Stripe, MailerLite, our online platform and other providers may also process information overseas; and

the privacy laws of those countries may not provide the same protections as Australian law.

By using a service involving overseas providers, you acknowledge this cross-border handling as described in this Privacy Policy and any specific collection notice.

We will take reasonable steps to select providers with appropriate security and privacy controls and to require them to handle information only for authorised purposes.

We take reasonable steps to protect personal information against misuse, interference, loss, unauthorised access, modification or disclosure.

Measures may include:

HTTPS encryption in transit;

access-controlled databases;

password-protected administration systems;

restricted team access;

multi-factor authentication where available;

secure payment processing;

data minimisation;

system monitoring and logging;

backups and recovery processes; and

secure deletion or de-identification when information is no longer required.

No online service can be guaranteed completely secure. You should protect your account credentials and notify us promptly of suspected unauthorised access.

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including service delivery, support, legal compliance, accounting, dispute resolution and legitimate business records.

Our intended retention approach is:

paid report information: generally up to seven years after purchase or the last relevant support interaction, subject to earlier deletion or de-identification where appropriate;

payment and tax records: generally up to seven years or the period required by applicable law;

free workshop registration information: generally up to two years after the last relevant interaction, unless a person has consented to ongoing marketing;

program and coaching records: generally for the period needed to administer the program, respond to issues and meet legal or business-record obligations; and

marketing records: until consent is withdrawn, the person unsubscribes, or the information is no longer reasonably required.

We periodically review retained information. We may retain information longer where necessary to comply with law, establish or defend a legal claim, resolve a dispute, prevent fraud or protect our systems.

You may request:

access to personal information we hold about you;

correction of inaccurate or incomplete information;

deletion of information that we no longer need or are not required to retain; and

information about how your personal information has been handled.

We may need to verify your identity before responding. We will respond within a reasonable period and explain any refusal or limitation where permitted by law.

Deletion may affect our ability to reproduce or support a report. We may retain information where required or authorised by law.

We may send information about workshops, reports, programs and related services where permitted by law.

You can unsubscribe at any time by:

using the unsubscribe link in the communication;

changing your communication preferences; or

contacting sss@wisdome.com.au.

We will not make continuing marketing conditional on your consent to receive marketing communications.

We may use cookies, pixels and similar technologies to:

operate and secure the website;

remember preferences;

understand website usage;

improve user experience;

measure campaign performance; and

provide relevant communications where permitted.

You can adjust cookie settings through your browser. Some website functions may not operate properly if cookies are disabled.

Our services are intended for adults. We do not knowingly collect personal information from anyone under 18 through paid report or program registration.

If you believe a person under 18 has provided information, contact sss@wisdome.com.au.

If we become aware of a data breach involving personal information, we will assess and respond in accordance with applicable law.

Where required, we will notify affected individuals and the relevant regulator.
